Bob Barr Cements Texas

By being the only presidential candidate on the ballot. Apparently everyone else forgot to file in time…

Section 192.031 of the Texas election code says that political parties must certify their presidential and vice-presidential candidates for the November ballot no later than 70 days before the general election. It says, “A political party is entitled to have the names of its nominees for president and vice-president placed on the ballot if before 5 p.m. of the 70th day before presidential election day, the party’s state chair signs and delivers to the secretary of state a written certification of the name’s of the party’s nominees for president and vice-president.”

This year, that deadline is August 26. UPDATE: At 2:30 pm Texas time, August 27, Kim Kizer of the Texas Secretary of State’s elections division says neither major party’s certification has been received in the Elections Division. The Executive Office of the Secretary of State refers all questions back to the Elections Division.

This year, neither the Democratic Party nor the Republican Party obeyed this law. See this link to the Secretary of State’s web page showing a blank for the Republicans and Democrats for president.

Well that kind of puts McCain in a bit of a bind now doesn’t? In all seriousness I’m sure some sort of workaround will be found.  But on a purely hypothetical level this oversight is highly amusing to consider for a spell.

    It’s funny how a workaround is assumed because its the Republicans and Democrats that screwed up. If any third party did this, they would never be allowed on. They make insane ballot access laws to protect their power, let’s see them follow them now. When they don’t (and I too assume they’ll be on the ballot), it will be plain as day how unfair our election system is.

    This shows the arrogance of the Repubicrats and Demopublicans.  Oh they will whimper and whine, but I hope Barr holds their feet to the Texas fire and doesn’t let go.  All politicians and parties need to be put in their HUMBLE place again.  Especially the Demopublicans who had a major tizzy fit about removing Michigan and Florida votes for Hillary on the basis of some obscur PARTY rule.  This here is Texas LAW.  Which goes way beyond a party rule.

    The law was changed in 2005, as it use to be 60 days - I think someone forgot to check with the Texas SOS. 

    The law is the law, and I hope Barr takes them to court to make them follow the law.

    Barr is the best candidate running for President and from what I understand is now in double digits in some states.

    Whoops!  I think the Dems and Repubs thought they would be able to wave this away, seeing as how they control politics in Texas.

    Will Texas follow their own laws?  I’m not confident in this.

    Michigan, Florida and the DNC certainly have not.  No reason to think that Texas will either.

    If the dems are smart, they will try to not let either of them on the ballot. The state is going to go McCain anyways. It would be a huge win for the Dems for Texas to go to Barr. Obviously not as big of a win as having the dems on the ballot and the Reps not on it, but still, this is a huge boost for Obama. It basically the same as if Georgia swapped from Rep to Dem in the final count.
